Way Off Target

Craig Fields, director of Internet operations for the Gun Owners of America, has a commentary supporting Net Neut* posted on the Conservative Voice web site. If he has a gun, let's all hope that he can shoot straighter than he does in this errant piece. Maybe there are times (very rare, I suspect!) when it will make sense for conservatives to jump in bed with MoveOn.org. But on this occasion, Craig and his fellow GOA'ers should put their guns back in their holsters.

The fundamental problem with Fields' argument for imposing Net Neut* regulations is that he still apparently believes, or wants us to believe, that we are living in a narrowband world dominated by the old Ma Bell. Wrong, Craig. We now live in a broadband world charaterized by competition enabled by rapidly emeging and developing new technologies. Despite the fact that the FCC has made this competitive finding countless times, there is not a word in his essay about competition to the telephone companies from cable companies, wireless companies, satellite providers, and emerging powerline companies. Not one word.

Regulatory Costs

In an editorial today on health insurance, the Washington Post makes what should be a perfectly ordinary claim: "The case for the Senate bill begins with a common problem to all regulation: By driving up costs it can end up hurting the people it's supposed to help."

The Post is often selective in worrying about the costs of regulation versus its benefits. And it is certainly true that there are many regulations that pass the benefit-cost test. But in this day and age it is nevertheless nice to have such a clear statement from a major newspaper that the costs of regulation often injure the very consumers that the proponents of regulation claim to want to protect.

Orwellian Net Neut* Speak

This debate about Net Neut* (see below) is getting weirder and weirder, if not downright Orwellian. Calling Net Neutering regulations "net neutrality" is one example. Here's another. Someone sent me a copy of Congressman Markey's Dear Colleague letter seeking cosponsors for his new Net Neut* bill. The headline blares: "Save the Internet As We Know It."

Now think about this. Markey acknowledges the FCC has already re-classified broadband services as non-common carrier services, removing what he calls the "historic protections" applicable to common carriers. But this took place in 2002 for cable broadband service and last year for telephone-provided broadband service. So, the Internet "as we know it" today and the Internet we have known for some time now has not been subject to Net Neut* common carrier regulation.

Seems to me to be working just fine, bringing the American public an ever-greater (mind-boggling to someone like me!) array of services that were unimaginable even a short while ago. I think Mr. Markey ought to be obligated to say what it is he wants us to be saved from with respect to the present Internet "as we know it." Because, remember, the Internet "as we know it" right now is not subject to Net Neut* mandates.

In other words, what I can't understand is how imposing new regulations will "save" something that is working well, at least right now, without regulations.

* I believe that imposing anticipatory broad-brush mandates preventing any differentiation of services on the net will diminish investment in new high-speed facilities and innovative applications, thereby neutering the net. So, in my view what the proponents of new Internet regulations are arguing for is Net Neutering, not Net Neutrality. Henceforth, I refuse to go along with the name game the Net regulators are playing by accepting the use of the "neutrality" claim. I say it's Net Neutering. But in the interest of being, uh, neutral, I am willing just to refer to the issue as "Net Neut*" with the universal asterisk indicating anyone can complete as they prefer ....That way, maybe we can strip the emotion out of the debate, and look at the economic realities.

Out of the Telechasm, Into the Spotlight

The WSJ's lead editorial today, entitled "Out of the Telechasm," [subscription required] prominently features Sen. DeMint's Digital Age Communications Act. It is no secret that here at PFF, we take some pride that Sen. DeMint's bill largely mirrors work produced in conection with our DACA project. (This is a real credit to the team of experts from PFF and other think tanks and universities who participate in the Working Groups.)

Please read the entire editorial. But here is one of the quotes endorsing the approach in Sen. DeMint's bill:

"Last year the FCC published a non-binding set of Net neutrality "principles" laying out what consumers are "entitled" to --basically, choices about the content they see, the devices they use and the networks they connect to. However, giving the FCC the power to enforce these rules against Web sites and network owners alike would open a Pandora's box of intrusive regulation and litigation. The far better solution would be to start from scratch, a la Mr. DeMint's Senate bill. It says, in effect, that telecom companies should be regulated on the basis of fair competition standards used everywhere else in the economy. Rather than trying to legislate competitive outcomes, as the 1996 Telecommunications Act did, Congress could allow open-field running save for anyone who violates antitrust rules."

The editorial concludes that "it's time to rethink, and the more fundamental, the better."

PS--Note that the editorial picks up on the point I've been making here and here that the Barton bill's incorporation of the FCC's net neutrality rules would give the agency "the power to enforce these rules against Web sites and network owners alike," opening a Pandora's box of intrusive regulation and litigation. For the life of me, I can't figure out why the Googles, Yahoos, and other Amazons of cyberspace don't foresee that they are putting themselves in a position where they will be forced to learn a lot more about FCC adjudication than they might like, and a lot more than will be good for the rest of us who fancy an unregulated Internet.

This is the way the abstact for a new Yale Journal of Law and Technology article [SSRN subscription required] entitled "Search Engine Bias and the Demise of Search Engine Utopianism" begins:

"Due to search engines' automated operations, people often assume that search engines display search results neutrally and without bias. However, this perception is mistaken. Like any other media company, search engines affirmatively control their users' experiences, which has the consequence of skewing search results (a phenomenon called "search engine bias"). Some commentators believe that search engine bias is a defect requiring legislative correction."

A Screen By Any Other Name

With the news that ABC is delivering popular "television" programming to a "computer" screen near you, can there any longer be doubt that the old regulatory and constitutional regime for video programming is crumbling? More and more prime programing, such as NCAA March Madness basketball games and that show about those Depserate Housewives, is now being delivered over the Internet and even via wireless to cellphone screens, not to mention over "cable" and "satellite" and "DVD", that it is clear that it makes no sense to regulate video programming differentially depending on the technological platform used to deliver it. Indeed, as I said in my recent testimony before the House Telecommunications and Internet Subcommittee:

"[I]n light of the competition that presently exists and which will continue to develop, the Committee should consider going further to reduce the regulatory requirements applicable to the cable operators, especially in the area of content regulation, where the First Amendment rights of the providers are implicated. And, once it establishes a national framework for cable operators applicable to new entrants and incumbents, as much as possible, it should apply to them in like manner."

"Google, Microsoft Subject to Net Neutrality Complaints"

That is a not unlikely future newspaper headline if the House Telecom and Internet Subcommittee bill were to be enacted into law as proposed. The bill gives the FCC the authority to enforce the FCC's broadband policy statement and the principles incorporated therein. The fourth principle says that "consumers are entitled to competition among network providers, applications and service providers, and content providers."

So far the focus of network neutrality proponents, including Google, Microsoft, Amazon, Yahoo, has been on mandating open access and nondiscrimination for network providers. But, as I pointed out in my House Telecom subcommittee testimony yesterday, the principles clearly would extend the FCC's authority to all the "layers" of the Internet.

No Nets--No Nothing

It's 9:42 pm and I want to get this over with early, and go to bed....Glen Davis and the LSU Tigers thrashed Duke. The Devils looked like they were in a hurry to be eliminated so they could get back to campus soon to start studying for finals.

So rather than "nothing but net", it was "nothing in the net". Congrats to the deserving Tigers...and what's that old saying about "wait until next year"?

Net Neutrality = Common Carriage

I participated in an FCBA seminar on Net Neutrality today. After listening to the proponents explain why they advocate an anticipatory NN mandate, I made a simple point up front. What is really being advocated is the impostition of a common carrier regime on broadband Internet service providers. In other words, let's call a spade a spade: Net Neutrality equals Common Carriage. At the FCBA program, Harold Feld of the Media Access Project and Jonathan Lee of COMPTEL both had no hesitancy whatsoever in admitting that their own view of a net neutrality means imposition of a traditional common carrier regime on broadband and in trying to defend this position.

I disagree that we want to impose a common carrier regime on an increasingly competitive broadband marketplace. Another way of saying that is that I am glad for the sake of sound communications policy that cable won the Brand X case. But what I am saying now is simply this: The whole net neutrality debate would make a lot more sense--and be conducted on a much more honest plane--if those advocating NN mandates just said, as Harold and Jonathan did today, that "What we want is to impose common carrier obligations on broadband Internet providers."

Net Neutrality Be Dammed!

Okay, settle down all you net neutrality proponents. You know me well enough to know I would never use even the "D" word with respect to you. No, what I have in mind is March Madness and the nets through which the Dukies will be throwing basketballs this weekend.

What I mean to say is that, as long-time readers of this space know, I am not neutral when it comes to the Blue Devils in March. I am hoping that J.J., Sheldon, and cohorts hit "nothing but net" enough times tonight to get by the pesky LSU tigers and then on to the Great Eight. If so, then watch this space for more devilry. (You can look it up!)

Rooting for the Blue Devils is something on which we should all be able to agree...Right?
