Is Video the Next VoIP?

By the time you read this blog, it's likely Pulver.com will have filed a petition with the FCC seeking to ensure that Internet video isn't regulated under Title III (broadcasting) or Title VI (cable) in the Communications Act. As Pulver's Jonathan Askin described it here at the VON Policy Summit in San Jose, it's the equivalent of the Pulver petition of a few years ago seeking protection for VoIP services from regulation. I haven't seen the new petition -- Jonathan said it would be filed at 9 am ET Tuesday -- but in general I am inclined to support less regulation rather than more. If Europe had such a policy in place, it wouldn't be able to consider an audio-visual directive that would impose broadcast-like regulations on the Internet.

That proposal, popularly known as TV Without Frontiers, was a topic of discussion on the panel I was on today. Ably moderated by 463 Communications' Sean Garrett, we touched on numerous issues, including the Viacom suit against Google, which dominated my recent panel discussion at South by Southwest. But this panel was far broader in scope. VON has traditionally been a conference about the Internet and voice, but this year they added the panel I was on to get a video perspective, and clearly Jeff Pulver and crew, the organizers of VON, believe video is the next VoIP.

Yes and no.

Dispatch from CES: More on Net Neutrality

Let me echo Adam's comments in his opening grafs about the circus atmosphere surrounding this debate. I also attended the session. After the session I met up with some folks from Panther Networks, an upstart competitor to Akamai, and in our short bus ride from the Las Vegas Convention Center to the Sands I heard far more insightful discussion about what NN really means than I generally do at these policy debates.

I'd also like to elaborate on Adam's discussion of the small cable operator's question. When he said a small percentage of users are dominating his upstream pipe, Misener's repsonse was that NN advocates believe carriers should be able to price-differentiate based on use. I see merit in that -- wireless operators charge differing amounts for differing bundles of minutes. But the carrier said that for various reasons he didn't think it was viable for him to price-differentiate (perhaps because he's in a competitive market, and his competitors are offering all you can eat, I wonder?). He said he'd prefer to use deep packet inspection, identify P2P traffic, and push that to the bottom of his priority list. Misener didn't say what he thought of that, but from what I've read of NN advocates, they would say that was discrimination.

We hear frequently about the number of people "signing" online petitions in favor of NN. Beyond the fact that it's name sounds so favorable that one would easily be inclined to support it without knowing more facts, I've often wondered if part of the reason you see those online signatures is because these people are online; NN activists seem to be the heaviest users of broadband. If networks started pushing the traffic of heavy users aside to ensure that all of its customers received a certain amount of robustness in their connection, they suffer. They're victims of "discrimination." So NN advocates, in signing online petitions, are acting in their own self-interest, trying to ensure the government enshrines their current ability to game the system for personal bandwidth advantage.

Dispatch from CES: Gates and Road Hazards

As Adam noted, he and I squeezed our way into a massive ballroom at the Venetian Hotel last night to hear Bill Gates. His appearances here have become so regular that it made me think of a high-fiber diet. It also creates pressure on him to top his previous performances with the next new thing, which is very difficult to do for anyone, let alone a man who clearly is very bright but would be the first to admit is not much of a performer.

Still, Adam and I learned a lot last night about Vista, which looks pretty remarkable. My HP Windows XP Media Center computer at home works great and does everything I need, so I don't know that I'll upgrade immediately, but Vista allows one to manipulate media in fun new ways, and it can turn your desktop wallpaper into a movie (people oohed when the waterfall wallpaper on the screen suddenly started flowing). Not sure we need that but it's cool. Adam learned that there are some fun new things he'll be able to do with his XBox 360 via a connection with a Vista PC.

I'm not a product reviewer, so I'll let you read the thousands of stories filed on the speech (you would not believe how big the media section was for the speech, and it still couldn't fit all the reporters). But I will note something Gates said right at the beginning of his presentation -- consumers want access to media when they want in the way they want it. He is of course right, and he's also not the first person to make this observation. Many of the hundreds of exhibitors here at CES are collecting venture capital and rolling out products based on that very premise. Microsoft has an excellent track record in respecting copyright, and is the author of major DRM software, so I trust Gates to be respectful of copyrights as he has his engineers develop all these new tools. I hope Microsoft's competitors are equally respectful.

Now for the silly product of the day. We all know that Steve Jobs has single-handedly given a boost to GDP with the cottage industry of iPod accessories 3rd-party manufacturers are producing. My son has an iDog and my daughter an iFish. But this product seems a bit, well, dangerous. I've seen people applying make-up and reading the paper while driving; I'm sure those dolts wouldn't hesitate to drive while wearing this.

Dispatch from CES: Scale and Perspective

Anyone who has been to Vegas knows that they don't do anything small here. One example of that from the Consumer Electronics Show:

Sunday at CES is the day the exhibitors finish bolting together their displays while their booth babes squeeze in one last trip to the tanning salon. With no trade floor available to reporters, it's also a day a lot of press conferences are held. I decided to attend one this morning by a major TV manufacturer. I stepped out of the Sands press room and saw a line of reporters that extended the entire length of the hallway (several football fields) that connects the Sands Convention Center to the Venetian Hotel. The line, once reaching the Venetian, made a right turn and continued. For some reason I joined the queue.

After about 20 minutes, at least 500 reporters ahead of me had managed to get into the room. The 200 or so of us remaining were told there was no more capacity. The press aide also said he couldn't share the announcements happening in the room until the event was over.

One, I have never seen so many reporters in one place other than at a reporter's convention. Two, I have never seen reporters so complacently standing in line and then walking away when denied entry. Reporters at conventions are used to being in the power position and play up their petulance accordingly; usually the exhibitors need us more than we need them. Not the case apparently for major exhibitors at CES, due to how many reporters attend. Three, what does it say about our society's priorities that nearly 1,000 reporters feel the need to hear immediately about the latest high-definition TV, yet I've covered a half-dozen major U.S. Supreme Court oral arguments and never seen more than 50 reporters in attendance?

The Panda Century

Can U.S. companies do business in China?

It's a question that will have to be answered with time, but today offered two signs of difficulty in the near-term. The big news would have to be eBay reportedly abandoning its own auction site in China, instead stepping aside to be a minority partner with a Chinese company, Tom Online. This contradicts CEO Meg Whitman's commitment to the Chinese market just two months ago. We were also reminded today of the high rate of piracy in China, but we also had good news as a Chinese court ruled in favor of five U.S. movie studios against a Chinese DVD store.

China often gives us mixed messages. It has home-grown companies looking to compete, but the question always remains as to what extent the government is putting its thumb on that scale. It has a general disdain for the IP of outsiders, but in needing to protect its own growing IP base finds itself needing to put teeth in its IP laws.

Trade and the 109th Denouement

As the 12-year mostly uninterrupted reign of Republicans on Capitol Hill came to a close over the weekend, some trade legislation was finally approved. This should be cause for rejoicing, but the fact is that these relatively innocuous bills needed to be crammed onto a Christmas-tree bill passed in the dead of night in the December of a lame duck when everyone wanted to go home. That does not augur well for the 110th Congress; hostility can be found in both parties against trade, but it's unfortunately higher in the Democratic Party right now.

I've written here and elsewhere about perhaps history's most articulate trade advocate, the 19th Century wit Frederic Bastiat. He's often referred to as an economist, but perhaps the most accurate description of him would be an economic journalist. Here in the 21st Century, the economic arguments in favor of an open economy and free trade seem irrefutable, yet more and more politicians -- and more and more members of the public -- are turning away from trade. The economists clearly are failing to get the truth across. We need another economic journalist to writ in language people understand, and we need politicians brave enough to do what's necessary to make a more open economy a reality.

Al Warren Brings Purple Pen to Pearly Gates

A journalism legend has passed away -- Al Warren, whose last name lives on in Warren Communications News, publisher of Communications Daily, Washington Internet Daily, Consumer Electronics Daily and Public Broadcasting Report, among others. While not the tallest man, he was a giant in the field of trade journalism. He joined Television Digest (as the company was originally known, named after the then-flagship publication) only months after its founding as a young reporter. There was this newfangled contraption called television, and Al Warren set about seeing how those crazy regulators in Washington might seek hegemony over the industry. Lots of publications wrote about television (including TV Guide, which briefly and disastrously owned Television Digest Inc.) but only Television Digest covered television policy. If memory serves, Al Warren bought the company from TV Guide (extremely impressive move for a reporter and employee), and oversaw its growth into the significant presence it is today.

Latest from Brussels on TVWF

Word is that representatives from the 25 European Union nations agreed today on language to update the Television Without Frontiers directive regulating broadcasting; the Associated Press has details. The debate focused largely on regulations restricting advertising -- how it can appear, how often, etc. The interest of some of us at PFF is the EU's goal of "harmonizing" regulations by applying broadcast rules to Internet transmissions, mobile video, etc. A piece yesterday in the International Herald Tribune touched on concerns about that potential overreach. Leading the call for a rewrite has been the UK, as I've written, but it appears that they've signed off on this latest compromise, even though some new media will be regulated. The article points out not everyone is happy:

"Nobody has explained to us really well what is and isn't covered," said Lucy Cronin, executive director of the European Digital Media Association, a lobbying group for companies like Google, Yahoo and Amazon.com.

The compromise was reached the same day a key committee recommended moving forward on the TVWF revision; approval by the European Parliament is likely the second week of December. It then under the EU co-decision process has to go back to the Council, although I confess the EU process is a bit opaque to me. What's clear is that it can't become law until at least 2009, due to a mandatory wait after publication, etc. It's intended to be part of the EU's Lisbon agenda, its i2010 initiative to boost innovation in Europe to a level comparable to the US and Asia; of course, I've argued the directive likely will stifle innovation, so its in Europe's best interest to delay implementation as long as possible.

Short answer: yes. But it's really more complicated than that.
