It seems oddly appropriate that the Brand X argument would be scheduled in the same week that Chairman Powell tendered his resignation. As Kyle has noted here before, "the Brand X case is critical to the FCC's overall policy of enhancing incentives for companies to invest in building high-speed networks." Thus, at issue will also be a significant aspect of Powell's legacy.
